Outpost Bills delayed but their presentation and passing is inevitable

They have to move on this issue. Fast. There are two MKs who are going to present bills on this to the Knesset and let's hope they are passed without much trouble.


"The bills would authorize even those outposts built on private Palestinian property and would provide the landowners with compensation.
At the Likud faction meeting MK Ayoub Kara said that such a move would be difficult, because no Palestinian could willingly accept compensation as an alternative without risking death.
The Palestinian Authority imposes a death sentence on any Palestinian who sells West Bank land to Jews; a move which has complicated authentication of land ownership in the West Bank."

MIGRON FACTS


1.       Building  the town of Migron  was not the unauthorised  decision of a band of people unrelated to government of Israel.  In 1999 the government of Israel identified the Migron hilltop area as a strategic place, from security and settling perspective.  It was uninhabited at the time.  Thus the government decided to establish a community on this very location.

2.       In addition, there is not one person who until now has been able to provide official documents of ownership of the land. It has all been hearsay, supported by a radical left wing political group in Israel whose agenda is extremely destructive to the state of Israel and opposed to its name Peace Now.  If such documents of ownership to even one plot of land on the Migron hilltop exist, let them be brought forward and the possessors of the document will receive that land or monetary compensation to the value of that land the day that they bring such a document.

3.       NO country in the world destroys the homes of its citizens. To do so, is destructive to the national morale and it is both immoral and inhumane.  There is no legal precedent for such action according to international laws, nor Israeli law and not even Jordanian laws which have some legal significance in Judea and Samaria. Even according to the Halachah (Jewish code of law) as set out in the Talmud, you pay money for land in good faith and if is discovered that the there is a claim to the land from a neighbour then the neighbour has the right to the field but he will need to compensate the buyers but he does not have the right to harm them. These laws are rather complicated but straightforward in essence if one really things about it.  (1) See NOTE below. The residents of Migron built their homes in good faith and made good and honest use of the land and cultivating it, planting and harvesting it.

4.       The residents of Migron settled on a rocky hilltop where there was not even one structure, tree or cultivated plot. It was desolate fields which was why the government of Israel chose that area.  If it can be proved that there are legitimate owners to the land, then they are liable for compensation for the value of the land, but they can not uproot the settlers of the land who have established in good faith homes and facilities on the barren sites and to throw them out in the wilderness. Such actions as taken by the Supreme Court of Israel is both inhumane and against all Jewish codes of law and goes against even compassionate treatment of any individuals or groups of people and their laws internationally. The government of Israel has an obligation and duty of care to discharge to the residents of Migron as we shall see in point 5.

5.       There was and is in place a plan by the Housing Ministry  and is submitted by the Ministry of Building for 500 additional housing units for Migron. On the deed submitted to the Housing Ministry, the landowner is the Appointee for the Government and Abandoned Property in Judea and Samaria. It is not private land but government land. Land in this category went all the way to the office of the Prime Minister of Israel who was then Ariel Sharon. Land that was registered to people who had abandoned it over 50 years ago was recognised as Absentee Land and the Absentee Land in Judea and Samaria now government property and land on which Jews can be permitted to settle.  If this was truly someone else’s land, why was no claim made previous to this time?  Thus such a claim to land termed as Abandoned Property in Judea and Samaria, should be seen as fictitious and malicious in intent without real basis. If there is no history of previous claims to the land and no complaints to the courts previously recorded about this land from the supposed owners in fifty years, than indeed there was indeed no real cause for this case to go to court.

6.       There is a community on the hilltop of Migron which consists of 50 families with numbers more than 300 persons. They settled there and built their families over the last ten years. Many of the children were born there. They have cultivated the land and built houses and facilities there. What government that is fair and just, mindful of its duty to its citizens does such a act as the uprooting of a community that has improved and settled on land abandoned and not used? What law court,  mindful both of natural justice and the international laws of justice, as Jewish Halachic Laws  makes such a decision and on what basis is this decision based?

7.       The mischief caused by radical organisations such as Peace Now is more than damaging to a few individuals, but damaging to the whole nation of Israel.   Indeed the government of Israel must  pass legislation to rectify a situation that has already gotten out of hand. Otherwise the whole country of Israel is on a suicide mission of appeasement.



8.      The feeling toward the Jewish homeland, Israel, was summed up by Shimon Ha'Chashmonaiof the Maccabees, the brother of Yehuda Ha'Maccabee. Shimon became the Jewish nation's leader after his brother died. Antiochus, sent his message to Shimon saying: "Return to me all the towns that you captured from me in the war, or, I will wage a war against you."



Shimon replied to Antiochus saying: "We did not take foreign land, and we did not assert control over foreign assets, but the land that is our inheritance from our fathers, which, at a time, without justification, was conquered and we, when we had the opportunity, reclaimed our fathers' lands." This reply is posted on the entrance to Migorn. Because we believe in it; we returned to be a nation; we did not invent ourselves; we existed for over 3,500years. We became a nation again in our homeland.

Son-in-law vs. Neighbor for Liquidated Apartment

A rich man became bankrupt and the beis din ordered him to relinquish his home to the creditors. Fortunately, one creditor was his beloved son-in-law and the house was transferred to his possession. The latter allowed his father-in-law to continue living there for free, but just as the older man started to feel more at ease, his adjacent neighbor complained to the beis din that he had been mistreated. After all, he was a bar metzra, and the beis din, as receivers of the property, should have offered to sell it to him first. However, the Chasam Sofer (Responsa, C.M. 11) refuted his claim, stressing that Chazal learnt the halachah of adjacent neighbors from the commandment in Devarim 6:18: do what is upright and good. The owner of a field next to one offered for sale profits from buying it by enlarging his property and should be preferred but not if he thus harms the seller. If, in this case, the beis din sells the home to the neighbor, he would evict the owner, who would become homeless. The house should remain the son-in-laws’s for the previous owner’s sake, who is being allowed to live there, as the neighbor is also commanded to “do what is upright and good”! (See Chasam Sofer, ibid, who cites more reasons as to why the principle of adjacent neighbors does not apply to such cases).

AJN reported Favourably on Friends of Migron International actions.

I read the above article and was pleased to see that positive comments were made and that the action taken by Friends of Migron International were favourably reported.
What irked me was the smug comment by Barrister Sam Tartarka that supporters of Migron and the people of Migron need to comply with the law (as if they are a bunch of criminals in the making and are already outlaws).
I would like to remind Barrister Tartarka who is the present President of the Zionist Council of Victoria just who he is representing and that there is no need to scold as if these people are a bunch of errant school children who may or may not break bounds and school rules.We are mature adults, most of us who do not need reminding about the differences between right and wrong.
Also Barrister Tartarka should be very aware that  laws are made for people to live by and not the other way round. Therefore the laws should be compassionate, JUST and OBJECTIVE. What the Israeli Supreme Court did was subjectively support the political agenda and interests of a group of people which went against the best interests of the country of Israel and its citizens.
But you know something, that aspect of the law is nothing new. Lately we have the victims of crimes receiving really very little compassion and all the empathy goes with the 'poor person who was abused as a child or teenager' therefore if he or she steals, lies, cheats, rapes or bashes or kills someone we must be sympathetic. You can only carry the sympathy card so far.
When you have the 18 year old youth who cut the throat of little baby Hadas Fogel OBM and her  parents and two older brothers get up in court and state that 'I am normal.' the world has come to a sorry state of affairs.  When such a person deludes himself that he is 'normal' I for one would rather be considered mad or abnormal. If he is to be considered 'normal' by some groups in the world, THEN G-D HELP THE REST OF US.
The thing is Barrister Tartarka is totally wrapped up in his perception of the law and fails to see the deeper implications of the moves being made against Israel through the Shomron towns and communities which will make the organisation which he is president of, redundant if the course of action started by the Israeli Supreme Court is to succeed. If I were him (luckily I am not and Thank G-d as I am happy being who I am) I would be looking with the other eager legal beagles at ways for Israel to annex the so called Territories Judea and Samaria and other parts of Israel territory that have been disputed for years and put everything under Israel law and be done with this mess. Should have been done years ago and I cannot see what is taking so long.  Is it because of world opinion?????

Not onemore Gush Katif; the story of the Friends of Migron.



There was a time I did not understand the ambiguous policy of the Government of Israel.  I also did not know much about the Jewish pioneering in Gaza, Judea and Samaria. I am a Jewess living in the United States.



In 2004, as on every year, I attended the Independence Day of Israel Festival, a yearly event in Los Angeles.  There I met a bunch of orange shirt wearers who introduced me to Gush Katif who informed about the impending expulsion and destruction of this community. Of course I signed their petition and as I didso I thought the government of Israel cannot do such an evil act against their Jewish citizens. Jews simply do not expel other Jews from their homes and making them homeless overnight.  These Jewish pioneers will remain where they are and such an expulsion will not take place.



How wrong I was.



A year later, despite petitions, demonstrations, public outcries and the resulting political rhetoric, in August 2005, the Government of Israel sent the IDF – the army its duty is to protect the Jewish people of Israel - into Gush Katif and in a massive operation forcibly expelled the 8,600 residents of Gush Katif, destroyed their homes, their established businesses and the infrastructure of the community, which had existed for twenty five years.  How and why they did it remains an enigma tome and a stain on the Israeli psyche.  This unilateral disengagement plan that Ariel Sharon, the Prime Minister at that time, convinced his government to support was a total failure and it has set back and badly compromised Israel's security in the south of the country. Gush Katif became rubble.



ArielSharon promised a positive outcome would result from the disengagement.  Yet, thousands of rockets and mortars have been fired into Israel since the removal of Gush Katif, causing fear, chaos and injuries and even deaths. Millions of dollars have been spent to fight the terrorist enclaves in Gaza and to keep the citizens of Israel safe.



To me, the unilateral disengagement from Gaza was a total failure. More so, it forced me to use a repulsive new terminology, a “Jewish Pogrom," Jews vandalizing other Jews, Jews expelling other Jews from their rightful homes.



The anti-Semitic Spaniards, of the March 31, 1492expulsions edict were laughing in their graves. We are now exonerated theywould have said if they were alive; if Jews can do it to other Jews, surely itis acceptable that non-Jews, who hate Jews, can do the same.



In 1967,in a brilliant and rather miraculous military operation that is part of warfare studies in military schools, Israel gained territories she lost in her 1948 Warof Independence, i.e. Gaza Strip, gained from Egyptian control, Judea andSamaria gained from Jordanian control and some land on the Golan Heights,gained from Syrian control.  Israel became a country from the [Jordan] River to the[Mediterranean] Sea, just as God promised.



As theBible tells us, in a special Covenant between God and man, in this alliance Godhas given Abraham and his seed after him a divine promise that cannot bewaived. Genesis Chapter 15: On that that day God made a Covenant with Avram saying,to your seed, I give this land, from the river of Egypt, to the big river, theEuphrates River... "



GushKatif, meaning, Harvest Bloc, was a bloc of seventeen Israeli communities inthe Gaza Strip in southern Israel. Late Prime Minister Yitzchak Rabinemphasized the fact that Gush Katif was essential to Israel’s security border.Ariel Sharon did not care what Rabin said; he had his agenda he was going toforce on the nation through lies and deception.



Gush Katifwas not the only place Jews settled after the 1976Six Day War victory.



With thestamp of approval from the Israeli government, Jews began settling theirancient lands - Judea and Samaria as well. However instead of making this land a natural part of Israel's sovereignty,Israel chose to exclude it and maintained the territory under military controland law. In other words, no matter Judea and Samaria is an important territoryto Israel's security and Israel’s rightful land, it could fall victim toanother unilateral disengagement, just like Gush Katif.



Today, forty-five years after the Six Day War, there are approximately 350,000 Jews living in Judea and Samaria; in other words, should such expulsion take place, it means, approximately 35 times the size of Gush Katif expulsion could take place. Who can tolerate that? I cannot!



To addmore fuel to the fire, in 1993, in the Oslo Accords, the government of Israelcame up with a new, not at all smart idea: to give the Arabs land, in Judea andSamaria, to establish their own independent state Palestine. Israel alsoconceded to their newly acclaimed name "Palestinians” thus giving birth toa new Arab nation that never existed before. Though the Arabs consider all ofthe state of Israel to be "their" Palestine, Israel thought that byconceding to such Arab state idea, the Arabs will be put off their goal toconquer all of Israel's land, to expel, or kill, all Jews and bring to an endthe ‘Zionist enterprise’.



How wrong  was the government of Israel yet again. By signing the Oslo Accords, Israel conceded to a new onslaught of political, media, diplomatic and intellectual terror warfare the Arabs launched on her.



Learning the lessons from Gush Katif, seeing how the Israeli Supreme Court, the Defence Ministry and even the Prime Minister's office act when it comes to the Jews living in Judea and Samaria, one can only predict, with trepidation, that more government wickedness is being prepared for their constituent Jews.  Knowing that the Government of Israel cannot be trusted, after all they lied in their promises to the nation in order to convince the people that Gush Katif destruction will yield good, precautions must be taken.



Through its fickleness, the government of Israel has created a new, but dark history, of approving and then destroying communities in Judea and Samaria. To mention one is the notorious and violent expulsion of Jews from Amona, a community that was once part of Mateh Binyamin.

But harshreality made me understand that surprises may come and soon.



The expulsion from Gush Katif was a shock to the nation and Jews in the Diaspora. A repeat of such action is unacceptable.



With theclear view that the policy of the Israeli Defence Ministry is bias toward Jewsliving in Judea and Samaria, I see the much spoken about case of the communityof Migron, a time bomb ready to explode.



Migron, foundedin 1999 in Benyamin 14 kilometres north of Jerusalem, with full approval andsupport of the government of Israel, is a community of 50 families with over300 Jewish souls, and is now in danger of destruction.



Theanti-Israel, pro-Arab-"Palestinians “organization Peace Now searched andfound some Arabs who can come forward to claim that they owned the land, withabsolutely no proof.  Along theirstandard approach to harassing Israelis and the legal system of Israel, PeaceNow then went to the High Court of Israel and made the claim to the land onbehalf of the Arabs. The court then ordered the community of Migron to beevacuated on the 1st August 2012.



EarlyApril 2012 a friend from Australia, who was greatly involved in petitioning against the destruction and evacuation of Gush Kati asked me if I will be part of a global petition to save Migron.



Readingreliable legal opinion that Migron has the full legal right to remain where itis, I did what any good member of the Jewish family would do, I said yes, and gotinvolved in the petition campaign to save Migron.  The battle for Migron is important, as thefate of Migorn is the harbinger of the fate of the 350,000 Jews living in theShomron - Judea and Samaria Area.



On Holocaust Remembrance Day, when we, Jews, stand in silence for the duration of the siren, to remember the six million Jews who were brutally exterminated by the savage Nazis. The Holocaust began by destroying Jews' property, burning their shops, and isolating them in Ghettos before sending them to Concentrations Camps – the Nazi killing factories. This kind of inhumane behaviour has been shown in Gush Katif and Amona.

It is timeto annex the entire Judea and Samaria and admit, to ourselves first, that theland from the Jordan River to the Mediterranean Sea is legally Jewish Land.



It is timeto open the economic gate and offer huge incentives to settle every possiblesquare kilometre of Judea and Samaria and to build and build and develop ourancient Jewish land.



It is timeto reverse the Supreme Court Order and allow Migron to remain and thrive on theprecise land where it was founded.



It is timefor the government of Israel to honour the Torah and to allow Jews to honourTorah as well.



It is timeto end any and all Jews against Jews acts; Jews do not demolish other Jews' homes.Jews do not uproot one Jewish tree; Jews do not destroy one Jewish home, evenif it is a caravan, in which Jews dwell. Jews do not destroy Jewish synagogues.The Government of Israel must immediately end the Pogroms it conducts, on aregular basis, in Judea and Samaria.

I have started a new blog which will be about Migron and for the purpose of putting up a collection of utube video clips about Migron and any news article links that I can gather to support the people of Migron and to help prevent its dismantling on the 1st of August, this year. I hope that the 13th of the month of Av will be a time for us all to begin to rejoice in an evil decree being averted through the efforts of Jews everywhere and Non Jews who support the state of Israel's right to exist.
